Terms of service
1. General provisions
These Purchase and Sale Rules (agreement) are a legally binding document that determines the mutual rights, duties and responsibilities of the Buyer and the Seller when the buyer purchases goods in the electronic store.
2. The moment of conclusion of the purchase-sale contract
The contract is considered concluded from the moment when the buyer pays for the goods after creating a shopping cart in the e-store.
Payments in the e-store are processed using the makecommerce.lt platform, which is managed by Maksekeskus AS (Liivalaia 45, Tallinn 10145, Estonia, reg. no.: 12268475), therefore your personal information required for payment execution and confirmation will be transferred to Maksekeskus AS.
3. Protection of customer data
For any information related to personal data that is registered in the Store, the following is collected:
- to process the buyer's orders for goods or services.
- solve problems related to the presentation or delivery of goods.
- fulfill other contractual obligations.
- after receiving the client's consent to inform by e-mail by mail or phone about store news.
4. Buyer's rights
The buyer has the right to buy goods in the Store in accordance with the procedure established by these Rules and the Store.
The Buyer has the right to withdraw from the Agreement concluded with the Store by notifying the Seller about it no later than within 30 working days from the day of delivery of the item.
Goods can be returned only by natural persons, the additional return guarantee does not apply to legal persons.
The Buyer can exercise the right to return goods only if the goods have not been damaged or their appearance has not changed, nor has they been used, and the original packaging of the goods has not been damaged, i.e. the product is not opened.
Buyer pays all shipping costs to return a quality item.
When returning the product, it is necessary to present the document of its purchase.
The returned item must be securely packed.
When returning a product, a request must be submitted, specifying the detailed order information: order number, date, product, price, delivery date. The account for the refund must be specified in the request.
The buyer is responsible for the smooth return of the product.
5. Obligations of the buyer
The buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.
The buyer undertakes to ensure the confidentiality of login data and not to disclose it to third parties. The Buyer is responsible for any actions of third parties, if they were made using the Buyer's login data.
If the data provided in the Buyer's registration form changes, he must update them.
When ordering the goods, the buyer undertakes to indicate the place of delivery of the goods and other data necessary for the delivery of the goods.
6. Seller's Rights
If the Buyer tries to harm the stability and security of the online store or violates his obligations, the Seller has the right to limit or suspend the Buyer's access to the online store immediately and without warning.
The Seller reserves the right at any time, without notifying the Buyer, to terminate the provision of services, change the store or its individual parts, all and any of its contents.
The Seller has the right to cancel the order without notifying the Buyer in advance, if the Buyer does not do so within 3 (three) working days after receiving the invoice for payment.
If there is any uncertainty regarding the information provided in the order, the Seller shall contact the Buyer on the phone specified in the order no later than the next working day from the day the order was placed.
In this case, the term of delivery of the goods starts counting from the day of contact with the Buyer.
The Seller has the right to cancel the order without prior notice to the Buyer if the Seller fails to contact the Buyer within 2 (two) business days.
The Seller has the right to extend the term of delivery of the goods if this happens due to circumstances beyond the Seller's control (for example, the manufacturer does not have the goods in stock, the transport company is late in delivering the goods, etc.). About it immediately by phone or e-mail. the Buyer is informed by mail.
The seller does not undertake to compensate the buyer for any direct or indirect losses caused by the late delivery of the goods.
If an error in the system results in an incorrect product price in the online store, the seller has the full right to cancel the buyer's order after informing him beforehand.
7. The seller undertakes
The Seller undertakes to enable the Buyer to use the services provided by the Store under the conditions set out in these Rules and the Store.
The seller undertakes to deliver the goods ordered and paid for by the buyer to the address specified by him.
The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous or similar product, the Seller undertakes to return the money paid to the Buyer within 7 (seven) working days, if the payment has already been made.
8. Final Provisions
The law of the Republic of Lithuania applies to these rules.
All disagreements arising from the implementation of these rules are resolved through negotiations. If an agreement cannot be reached, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
